The protection of your personal data is of particular concern to Austrosoft Weiss Datenverarbeitungs GmbH and fms GmbH (hereinafter "fms/Austrosoft" or "we" or "us"). We know that it is important to you how the personal data we receive about you is used and shared, and we take your privacy very seriously. This privacy policy describes fms/Austrosoft's data protection practices in relation to information you provide to us through the websites we operate (www.austrosoft.at, www.fms.at and www.newmoo.at). We process your data exclusively on the basis of the applicable legal provisions (GDPR, TKG 2003).
This privacy policy does not apply to the practices of third parties that are not owned or controlled by fms/Austrosoft, nor to persons who are not employed by fms/Austrosoft or do not receive instructions from fms/Austrosoft.
Personal data. "Personal data" is information that directly or indirectly identifies you or another person and may include: name, title, company name, job title, postal address, telephone number, email address, browser and device information (including IP address) and information collected through cookies and other similar technologies. If you submit personal data about other persons to us or to our service providers in connection with the websites, you represent that you are authorized to do so and that you permit us to use the information in accordance with this privacy policy.
Other information. "Other information" is information that cannot be used to reveal the identity of you or another person, e.g. information that has been fully and permanently anonymized and aggregated. We use such information to enable and improve the operation of our websites and for the other purposes described below.
Through the websites: We collect information through the websites, e.g. when you download content (e.g. product brochures), subscribe to our email newsletter or contact us.
Offline: We collect information about you offline, e.g. when you attend one of our events, during telephone conversations with field representatives or when you contact an fms/Austrosoft representative.
Through you: fms/Austrosoft collects information such as your location or preferred means of communication when you voluntarily provide us with such information. Unless this information is combined with personal data, it does not personally identify you or other users of the websites.
Information from other sources: To better enable us to provide you with relevant marketing, offers and services, we obtain information about you from other sources, such as public databases or other third parties.
Through your browser or device: Certain information is collected by most browsers or automatically through your device, e.g. the MAC address, computer type (Windows or Macintosh), screen resolution, operating system name and version, device manufacturer and model, language, internet browser type and version, and the name and version of the websites you are using. Your "IP address" is a number that is automatically assigned to the computer you are using by your Internet Service Provider (ISP). The IP address may be automatically identified and recorded in our server log files along with the time of the visit and the pages you visited when you access the websites. Collecting IP addresses is standard practice and is performed automatically by many websites, applications and other services. fms/Austrosoft uses IP addresses to calculate website usage levels, manage the websites and monitor the regions from which you navigate to fms/Austrosoft websites.
Through cookies and other similar technologies: "Cookies" contain commonly used information in the form of small files that are stored on a person's device to make it easier for the person to communicate and interact with the websites. When you visit our websites, we may send one or more cookies to your device. The cookies enable us to store information about your device, which among other things helps us to provide you with a good browsing experience on our websites and to improve the level of services and features offered.
This website uses Google Analytics, a web analytics service provided by Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland. Google Analytics uses cookies that enable an analysis of your use of the website. The information generated by the cookie about your use of this website is usually transferred to a Google server in the USA and stored there.
IP anonymization: We have activated the IP anonymization function on this website. This means that your IP address is truncated by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area before being transmitted to the USA.
Purpose of processing: On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide other services related to website activity and internet usage to the website operator.
Legal basis: The use of Google Analytics is based on your consent in accordance with Art. 6(1)(a) GDPR. Google Analytics is only activated after your explicit consent via our cookie consent banner.
Revocation: You can revoke your consent at any time via the "Cookie Settings" link in the footer of our website. The lawfulness of the data processing carried out until revocation remains unaffected by the revocation.

To provide our services in accordance with our terms and conditions, for correspondence with customers and suppliers and for the proper execution of orders and deliveries of our products as well as for the processing of payments communicated to us in the course of the business relationship.
To respond to your inquiries and fulfill your requests, such as sending requested materials and newsletters as well as information and materials about our products and services.
To send you administrative information, e.g. information about the websites and about changes to our terms and policies.
To send you marketing communications that we believe may be of interest to you, including by mail and email in accordance with applicable laws and your preferences.
For our business purposes, such as improving or modifying our websites and services; identifying usage trends; determining effectiveness.
Our legal basis for collecting and using the personal data described above depends on the specific context in which we collect it. We will collect and use your personal data when the processing is in our legitimate business interests, such as for direct marketing and selling our products to potential business customers (B2B). In some cases, we are also legally obligated to collect personal data from you.
To ensure your private protection, state-of-the-art security standards are used. The protection of this data and the personal rights of our customers are very important to us. Confidentiality is a matter of course.
If you wish to access, correct, change, remove or restrict the use or disclosure of your personal data collected and stored by fms/Austrosoft, or if you wish to have it transferred to another organization, please inform us at datenschutz@fms.at so that we can review and respond to your request in accordance with applicable law. If you wish to object to the processing of your personal data for direct marketing purposes, please use the mechanisms described in Section G. For your protection, we only implement requests relating to personal data associated with the email address you use to send us your request, and we must verify your identity before implementing your request. We will respond to your request within 30 days. Please note that we are required by law to retain certain data and/or to complete transactions that you initiated before requesting such access, change or deletion.
We will retain your personal data for a period appropriate to the original purpose of the data collection, including the pursuit of our legitimate business interests, compliance with our legal obligations, the settlement of disputes and the enforcement of applicable agreements.
You may choose not to disclose any information at any time. However, if you choose to do so, we will likely only be able to respond to your inquiry or provide you with limited services. You can opt out of receiving marketing messages from fms/Austrosoft by following the unsubscribe or opt-out link in an email, or by writing an email to datenschutz@fms.at. We will comply with your request as soon as possible. In the event that you opt out of receiving marketing-related emails, we will still send you important administrative messages.
The websites allow you to access other websites on the Internet via direct links, and other websites may also contain links to our websites. The information practices or content of other websites are governed by the privacy policies of those respective websites. Please also note that we are not responsible for the data collection, use and sharing policies and practices (including data protection practices) of other organizations such as Facebook, Google, LinkedIn, Microsoft or providers of social media platforms, operating system providers, mobile providers or device manufacturers, including any personal data you share with other organizations through or in connection with the apps or social media pages.
fms/Austrosoft may change this privacy policy from time to time as circumstances require. The "Effective date" at the top of this page indicates when this privacy policy was last revised. Changes to this privacy policy become effective when we publish the revised privacy policy on the websites.
